Re: unregistered gun and intent to distribute....

I spoke with him saturday. I had had a few drinks so I was able to tolerate him a bit more than usual, and since he and my future SIL are now engaged out of nowhere I guess I'd better get used to him.

I asked him what the deal was with the gun when he got arrested and told him what the girls' theory was. His response was that she didn't know what she was talking about. He said when the cop stopped him and found weed and a gun he started treating him like a dealer....I gave him a "well...duh" sort of look at this point i'm sure, since I become even more blunt with alcohol in my system. But the cop told him he was confiscating the gun and he'd never get it back, and that it was an unregistered gun. His explanation of the latter part was just that the cop was clueless about the law(throughout the rest of the night I found out that so is he).

So he went to court and plead guilty to the possession charge, and the judge tried to throw in a weapons charge as well for having an unregistered gun, and he then pointed out that there was no such thing in this state and he even had his firearms permit so he was well within his rights to have the gun especially in his car(this is obviously true...except for the with weed part). So the judge told him he wasnt sure about all of that but would review the law and past rulings and whatnot. And a week later ol dude had his gun back.

Hes a much more tolerable human being than he was when we were in middle school together, but again, that could've been the alcohol.

Dude really has no clue about gun laws though, so my other F-SIL's husband and I tried to educate him a bit. He's pretty knowledgeable of general gun laws and I'm pretty knowledgeable of Mississippi's carry laws(at least compared to those 2 I was).

He told me he'd gone in Bass Pro looking for ammo for his m&p, and went to the counter for help finding it and didn't know what kind he needed(other than .40) so he offered to take the gun out and find out...of course they shot that idea down, and told him to just go to the bathroom and eject the mag and check it.

Also not too long ago he was at his now fiance's apt and their little girl was running around a bit and the downstairs neighbor came up to complain about the noise, and he told him to chill out because they had to listen to his parties all the time blah blah blah, something was said or shown because the cops showed up and knew he had a gun. They cleared and checked it when they arrived. And last night he told us the cop told him the gun was dirty, and he didn't understand how the cop figured since it had been cleaned right after he shot it when he first bought it.....me and the other guy were slightly astounded(because he'd had to clean the gun for him, and it had been about 6 months or so). So he explained to him "think about it, I get up, shower, get dressed, take a dump, eat walk around, etc all throughout the day...and at the end of the day ive always got belly button lint...your gun is the same way." and I explained to him that even in a proper holster mine collect lint, so his without a holster in his crotch is of course going to attract excess lint.....

I dunno....I just hope the guy will straighten out because if he slips up with my niece in the car or just around him, it's gonna get ugly. And since they've screwed up their family situation so bad I was around a lot more than he was(he only recently found out about her) so I'm pretty protective of her, as is her other uncle.

And if he stays straightened out then We've got another gun enthusiast in our ranks

I sold a pistol to a friend who later gifted it to his son for Christmas who then took it back to LA where he was arrested for an "unregistered pistol" even though all transactions were legal. He eventually got it back. Being as you are only supposed to buy pistols from inside your state maybe it didn't show up when they ran the numbers. Then again you HAVE to register a pistol in LA within 24 hours of bringing it into the state.

I do know that the MS handgun permit packet states that you are considered a "habitual user" if you have been convicted of even a misdemeanor possession of a controlled substance within a few years so technically his permit should have been pulled and he would have to lie on the form to purchase a gun.
