guns & drugs

msduckslayer asked a question about drinking with a gun. i have one about drugs. i have a broken back and spinal cord injury, i take some strong pain medication, it does not affeccet my judgement( does not affeccet pain either) so i was thinking should i carry in public. i dont have a perrmint but was thinking about getting one. i do put my gun in the truck when i leave the house. thinking

If an officer had a reason to question your sobriety or to believe that you were impaired, being under the influence of drugs (even with a perscription) is viewed in the same way that being under the influence of alcohol is. A blood test would reveal any intoxicants, drugs or alcohol.

He could only charge you with DUI or some sort of public intoxication (which is doubtful). You cannot be charged for carrying a weapon while intoxicated or while in possesion of a legally prescribed drug.

No enhancement for prescribed drugs, however their is an enhancement for illegal substances or certain controlled substances without a prescription = the enhancement is up to twice the fine and/or jail time..

Interesting one for you, I've been on Adipex(sp?) to help me lose weight since November, gotta get off it for at least 6mos now, and one of the side effects is a "fight or flight" response to stressful situations...I haven't had any problem out of this, until tonight when I got pretty confrotational with my future sis-in-law's current boyfriend about his attitude, it got heated for a minute till I had sense enough to just walk out, and he drove off a few minutes later...of course I was the bad guy and blah blah blah.

Normally I don't get confrontational about anything, but this medicine certainly puts me on edge, but not too extreme. That's just an example of how meds can alter your thinking. I was armed during that argument(not sure if he knew it or not), so if things had escalated who knows how that would've turned out in court.

But in a situation on the street if someone were to do something that set off a response from me and I used deadly force, and it might've not been completely necessary, I would think that a judge, and a good defense attorney would try to turn it into temporary insanity, because even people not acting under the influence of meds who have a fight or flight reaction often have little to no control of their actions, and I'd think that would go for MOST drugs/alcohol related situations

yes it is. the drugs i take say do not drive or use dangerous equipment till you know how it will effect you. what i am asking also is do i steal have the right to defend myself and my family. I WILL ANYWAY !!! just want to know what yall thought. thank yall

I would also defend my family or myself whether I had been drinking (over the limit or not). They charged Steve McNair with illegal possession of a firearm when he got his DUI, even though he had a permit. Your concealed carry permit is void if you are under the influence. Think they gave McNair a slap on the wrist, wouldn't be so lax on us regular folks.

If you are in your car you can have your gun on you or anywhere else permit or not. If you get stopped you notify the officer that you have a firearm on your person. If the officer for whatever reason tells you to get out of the car before being disarmed your not going to get convicted of carrying a concealed weapon when you have been giving a lawful order to exit the vehicle.. The key part is notifying the officer.. If you are charged it will be dismissed if you have any kind of representation due to entrapment. It all boils down to state laws.. In MS we are able to have a loaded weapon in our vehicles without any regulation. BTW charges against Mcnair were dropped due to the lack of evidence! TN laws are way stricter with alcohol related crimes.

In TN the gun has to be unloaded with the ammo stored separately. Being that he was intoxicated his permit was null and void at that point therefore his gun had to be unloaded and ammo stored separately.
