Domestic violence question

Post by 94LEVERFAN on Thu Aug 25, 2011 8:01 pm

Friend convicted of misdemeanor domestic violence in city court. Bullshit conviction, don't know any other way to put it. This girl loves to hunt among other things, any suggestions other than the obvious to appeal it to a county court? Has already spent more money in bail and attorney fees than she can afford. Any suggestions appreciated. Thanks, 94 Lever.

Thanks for input TomBomb. Was hoping gunluvn or 2A would chime in on this. Clock is ticking on time to appeal this. Any other opinions?

In my opinion, many of our country's firearms laws are seriously flawed or misused; this isn't going to change until somebody goes to court to fight it. It should be obvious that our spineless "leaders" have very little interest in preserving our rights, only their office/position, so legislative improvment isn't likely. "Shall not be infringed" has lost some meaning here.

Perhaps your friend could appeal to the NRA, or some other similar group, for support in filing an appeal?

In her position, could she use black powder weapons? They are viewed differently from modern firearms in some parts of the law.

Giving legal advise without any facts is dangerous; especially from non-attorneys ..... I know nothing of the events, charges, etc. I would certainly think that IF she does not appeal - she will be stuck with conviction ....

Cap, not xactly lookin for legal advice, just wondering if there were any remedies available if this conviction stands, and what they may be. Will try to put together a post in the morning giving a few details. Would appreciate any LEO or attorney comments. Thanks.
P.S. Not looking for free legal advice or anything to hold someone to. Looking for OPINIONS or OPTIONS. Any and all replies appreciated. Thanks, Bruce, 94 Lever.

... IIRC, you can have your rights reinstated by a judge ....

Maybe Bow-hunting?

Sounds like some serious legal work has to be done now that the conviction is in.

If you can afford to file an appeal, yes by all means. Lets start over.
Wife comes home, hubby bitches, ain't their first rodeo. Gets physical, she defends herself. Gets started again, dials 911 for help, when law gets there, she is arrested cause he has a bloody nose. Friday night, bond set Saturday at $15000. Get her out Monday night after bond reduced to $5000. At court hubby says wife pulled pistol on him. Bull$hit, didn't happen. Cops didn't know she even owned a pistol. Long story short, she dialed 911 looking for help. Spent 3 days in jail and about $1600 so far(which she didn't have or can afford). You think this girl will EVER call 911 again. She will either stand there and get her ass beat or pick up somwthing and beat her attackers ass to death since she cannot legally own a firearm. How F.U.ed is this?

Lever:

I'm not trolling for business, but here are a few general things to consider:

Mississippi Domestic Violence Gun Implications

Should I Appeal my Criminal Case in Mississippi

Time Limit for Appealing a Criminal Case in Mississippi

"Standard disclaimer," not legal advice, may not be applicable to your situation, you need to consult with an attorney if you want to pursue it, this does not mean I am your attorney, blah, blah,

Good luck with it,
