The folks arrested won the lawsuit last month, and rightly so. As I stated in my previous post on the Hispanic-American issue, just because someone looked like they were of Hispanic decent gave the officer “suspicion” that they may be here illegally and allowed that officer to stop him and have him prove he is here legally.
The Federal Government does not agree. Every state that has put in place any type of law allowing officers to check for legal status has been sued by the Federal Government and every time it has gone to court the Federal Government has won.

Yep. No different in this case. I agree with Q-tip that the officers were in the wrong to even ask, let alone take him to jail for it, BUT the man was a fool and obviously just acting an @$$ and wanting attention for himself and/or his organization you saw in the video. I can't say that I wouldn't have acted the same if I were in the cops shoes, at least as far as making the arrest goes, since refusing to cooperate would give mete understanding that you clearly have something to hide.

Kevin, I have to call BS on this. You evidently haven't read the law. The law states they can ask for proof of citizenship only during a legal stop or arrest. NOT as you stated if they think you look hispanic. The Mods have been very clear before that LEO bashing isn't allowed on this forum. Keep it truthful or keep quiet.

I don't think the police have the right to demand a ID but if you have nothing to hide why bother with the hassle. I'll show them my permit and be on my way while they sit around waiting on the lawyer to show up. There is enough trouble out there waiting to happen without going out looking for it.

After researching this issue more, I can see now where everyone is coming with this. I looked up the laws and court cases that has to deal with this issue and now see it from a different perspective. I was mistaken, misinformed, and jumped in without doing the proper research. It won’t happen again.

You just increased your cedibility with me and quite probably others with this post. I've been called to task before and it was usually because I repeated something without verifying it first. If I do so again, I hope you will point it out to me.
