carrying in a bank?

Post by dhollis51 on Tue 18 May 2010 - 13:07

just had a conversation with the security guard at my bank and asked her about carrying in the bank and she said it was illegal for anyone not in uniform to carry a firearm in the bank. So what is yalls take on it? and I know the common stance of what they don't know want hurt them so avoid that stance. Is it legal or not?

The security guard at your bank is full of hooey, ignorant, or both. There is no MS State Law and there is no federal law that prevents carry in a bank by anyone legally able to carry a firearm. There are a couple of states that prevent it by state law, but MS is not one of them.

This was my understanding also. I have never removed a firearm to enter a bank.

Lets try this again, dammit. Was in my regular bank in Bolton 5 or 6 years ago not long after my truck was stolen. New truck, first trip to home depot, some SOB steals ruger 45 out of truck. Add new security system to truck. Anyway, back to bank. Talking to branch manager about theives and such, telling him what I would do to the first SOB I caught stealing something when an alarm that sounds EXACTLY like mine goes off outside of bank REAL CLOSE to where I was parked. Had my pistol out of holster before I was out of his office and ran thru lobby. Turns out it was somebody elses vehicle, not mine. Banker knew I was not playing tho. Funny now. It aint agaist the law to carry in a bank.

It's not illegal...unless they have signs posted at the entrance of the lobby

First, it is completely legal. Second, what kind of uniform, I wore my pistol in many banks in jackson working for Loomis. I wore a uniform then. I wear a uniform shirt at Nissan. Does that count as a uniform? What about armed security guards? Does their uniform count? Ask your security guard that and see what she says.

It's common misconception.

Banks are federally insured, not federally owned property.

the great gonzo and msredneck have it correct. Unless it is legal posted as no guns allowed then you can carry. I along with 2 others at my bank carry and it is not unusual to see a customer walk through with a gun they have bought or traded for to show one of us. They do typically have the good sense to let one of the secretarys know before they come walking in w/ a gun.

I don't know the background of the guard at that branch. I've found that in most cases, only our current and former LEOs who do security know the rules/laws or even bother to learn them. The career military guys are usually pretty knowledgeable too.

When I think about it, they're only a couple of guys I work with that even own a gun of their own.

thanks BeRich. I went to two other branches yesterday due to my debit card not working after I activated the new card and it works in the ATM but the credit part does not work. Went to terry road branch and talked to the guard there he was a little more knowledgeable

I was just told that only leos are allowed to carry in Trustmark in Ridgeland on Hwy 51. Darlene told me thatI was not allowed to bring my firearm into the bank and I told her that indeed I was. She said not unless you are a cop. I told her that the state law allowed me to do this unless it is posted at the door. She had no further comment. I left. She has seen me many times before open carry in the bank...or...maybe not. I don't rwally make a showing of it, but it is quite obvious. P-94 strapped to my strong side hip. I hope she is better informed now. She seemed a little confused at the time. I plan on writing her an email later to let her know the law and to try to keep it friendly. I hope to change her feelings about it.

It's weird that Pearl has an ordnance that forbids carrying in financial institutions. I've contacted the city council twice by email to change this illegal ordnance, no response so far. Preemption does not give cities or counties authority to put in place such an ordnance.
