A cop told me this...

Post by bensand26 on Mon Sep 06, 2010 5:10 pm

in a conversation with a leo i was told the following, "In MS, you cannot have a gun in your car within reach or visibility." he swore that it was a crime to do so and he would take you to jail immediately. I have never heard of any law or statue saying so. The officer told me it was illegal to have the gun loaded and/or the magazine within reach.

Either i have been lied to by everyone i have ever known, or this cop is mistaken.

so my question is, what is the law on the issue? and how can we deal with the dumb*** cops that do know even know what their job is???

(disclaimer: i know there are a few of these honest police officers out there and i commend you for knowing the law and doing your job. You provide a valuable service) This post refers to all the "other" guys.

The amended MS concealed carry law states Except in any vehicle. I would sue the officer personally if I were arrested for his so called offense. The vehicle is an extension of the home in Mississippi and Louisiana.

I'm with Doug on this one. My dad is a retired LEO and he says car is extension of your home and its legal to have it in sight and within reach just as if you were sitting at home.

It shall not be a violation for any person over 18 to carry a concealed firearm within his home, place of business, or real property associated with his home or place of business, or within his motor vehicle.

It shall not be a violation for any person to carry a concealed firearm when engaged in a legitimate weapon-related sports activity or in going to or from such an activity, or who possesses a concealed carrying license issued by the Department of Public Safety.

I would keep a copy of the LAW in the car to show the missinformed LEOs.

Many years ago I had a neon tag bezel that glowed BLUE. I researched the subject of a BLUE light on a motor vehicle. The law basically states.... the BLUE light can not blink, rotate, or ocilate (sp). The few times I was stopped I showed the LEO the LAW and they went on their marry way.

If they want to push the subject... First ask politely (then demand) their name, badge number, department name, commander's name. Tell the LEO you need this info for the report you are going to file with their department.

Carrying a copy of the LAW usually resolves the "problem" quickly. And, be polite. Don't act like a jerk or the LEO might "find" another reason to arrest you.....
